EB-3 Visa Jobs Requirements
According to USCIS, as a foreigner, you may be eligible for employment-based immigration, the third preference category if you’re a skilled worker, a professional, or an unskilled worker.
- A skilled worker must have all the educational requirements or the experience needed for the job.
- You must have a U.S. baccalaureate or its foreign equivalent if you’re a professional.
- The unskilled workers’ subcategory, is for persons performing unskilled labor that requires two years of training or less.
In addition to the above-listed requirements, there are also other requirements for each applicant in all three categories. Each applicant must be able to prove the following;
- That they have a valid and permanent job offer from an employer based in the United States.
- They are amply qualified to meet the requirements and conditions for the job offer in terms of academic qualification and job experience.
On the other hand, the employer in question also has to meet up to certain criteria before being allowed to sponsor an employee on an EB-3 Visa. The sponsor must prove;
- That they could not find an available, qualified and willing U.S. worker to fill the position in question.
- The sponsor is financially capable of paying the worker the agreed-upon wages, and can also afford to sponsor the workers’ visa and other agreed-upon expenses.
EB-3 Visa Sponsorship Jobs Application Process
If both the worker and the sponsor meet the requirements, they can proceed with the application process. Usually, an application for an EB-3 visa takes nine months, but if there are any hitches along the way, it could take up to two years.
The process has multiple stages, which involve both the sponsor and the prospective employer.
- First, the U.S. employee must obtain labor certification and file the appropriate petitions.
- If the sponsor can get the certification and the petitions are also approved, then the employee can apply for the EB-3 visa at the U.S. embassy in their country of origin.
EB-3 Visa Process For The U.S. Employer
There are two things that the U.S. employer has to do before he will be allowed to sponsor a foreign worker to enter the U.S. on an EB-3 visa.
Obtain Labour Certification
The first thing the employer has to do is obtain a labor certification from the U.S. Department of Labor.
To do that, they have to prove that neither they nor their company will discriminate against the employee.
The employer also has to state that at the time of filing for the certification, there were no available, qualified, willing or able workers to take on the position that the foreign worker is being employed to fill.
And that as a result, the foreign worker will be paid a prevailing wage for their services. The employer will state and prove the lack of U.S. employees and their willingness to pay a prevailing wage by filing ETL Form 9089 to the Department Of Labor.
If the DOL grants the labor certification, the employer will move on with the process.
File The Petition
The U.S. employer also has to petition the U.S. Citizens And Immigration Services. The employer must also attach financial statements, tax returns, and invoices to the USCIS. If the USCIS approves the petition, the case will go to the National Visa Centre.
The NVC will then send the foreigner a package with the case number and the Visa ID number that they will use for their application.
EB-3 Visa Process For The Foreign Worker
The foreign worker will fill out a form online and submit it to the U.S. embassy in their own country. The form will serve as their visa application.
The worker must undergo a complete medical examination and vaccination.
The foreign worker must compile the EB-3 visa supporting documents file.
Afterward, they will attend the visa interview.
If the visa is approved, the NVC will send some documents to the worker. Those are the documents that the foreign worker will use to enter the U.S. They are not allowed to open the documents under any circumstances. Only the immigration officials can do that at the point of entry.
